Terms of Service

These Terms of Service ("Terms") govern your access to and use of Concorso, a job, client, and schedule management platform for automotive reconditioning businesses, operated by Concorso ("we", "us", "our") out of Toronto, Ontario, Canada. By creating an account or using Concorso, you agree to these Terms. If you don't agree, don't use the Service.
1. Description of Service
Concorso is a software-as-a-service platform that helps automotive reconditioning businesses manage jobs, clients, scheduling, invoicing, and their team. We may add, change, or remove features at any time.
2. Eligibility & Account Registration
You must be at least 18 years old and able to form a binding contract to use Concorso. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at hello.concorso@gmail.com if you suspect unauthorized access.
3. Free Trial & Billing
New accounts start with a 30-day free trial. After the trial, continued use of paid features requires an active subscription billed through Stripe. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period, and we don't provide refunds for partial periods except where required by law.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, or to violate any third party's rights;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse-engineer, resell, or use the Service to build a competing product; or
- Upload content you don't have the right to share.
5. Your Content & Data
You own the business, client, and job data you enter into Concorso ("Your Content"). You grant us a limited license to host, store, and process Your Content solely to provide the Service to you. We do not claim ownership of Your Content, and we do not use it to train third-party AI models or sell it to anyone.
6. Team Members & Invitations
If you invite team members, you confirm you have the right to share their name and email address with us for the purpose of sending them an invitation, in accordance with our Privacy Policy and applicable anti-spam law (CASL/CAN-SPAM).
7. Third-Party Services
Concorso relies on third-party providers — including Clerk (authentication), Stripe (payments), Convex (data storage), and Vercel (hosting) — to operate. Your use of the Service is also subject to the applicable terms of these providers where you interact with them directly (for example, entering payment details with Stripe).
8. Service Availability & Disclaimers
We aim to keep Concorso available and reliable, but we don't guarantee uninterrupted or error-free operation. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONCORSO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
10. Indemnification
You agree to indemnify and hold Concorso harmless from any claims, damages, or expenses arising from your use of the Service, Your Content, or your violation of these Terms.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, or with reasonable notice for any other reason. Upon termination, your right to use the Service ends, though provisions that by their nature should survive (ownership, disclaimers, limitation of liability) will remain in effect.
12. Governing Law & Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms will be resolved in the courts located in Toronto, Ontario, unless applicable consumer protection law in your jurisdiction requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service before they take effect. Continued use after changes take effect means you accept the updated Terms.
